South Florida sees another drop in bankruptcies in July
Residents of Southern Florida are likely all too aware of the financial issues those around them have been dealing with. For a time, there seemed to be no end to the number of bankruptcy filings that were occurring in South Florida. Over the course of the past few months however the number of Chapter 7 and Chapter 13 filings has been decreasing. A head of family who pays for more than 50% of a dependent?s living expenses cannot be garnished if their net income after deductions is less than $750 per week. If the head of family earns more than $750 per week after deductions, then they can only be garnished on the amount that exceeds $750 if they signed a written waiver allowing a creditor to seize income. In other words, a head of family cannot be garnished unless they agree in writing to be garnished.

For the fourth consecutive month ending in July, the number of bankruptcy filings in South Florida fell. Between June and July, filings dropped by 3.5 percent. When compared to one year ago, the decline is an encouraging 18 percent. There are a number of reasons behind the reduced volume of bankruptcy filings. While some people are still facing significant financial challenges, attorneys are reporting that some homeowners are successfully exploring other options, such as a home mortgage modification.
